Expertise

Collaboration

Collaborative law is a private dispute resolution mechanism where clients and their lawyers commit in writing to resolving the dispute without litigation. To do so, they bring in third party professionals such as accountants and parenting experts as needed to work through any issues which present themselves in the negotiation process. Parties typically commit to the collaborative process at the beginning of the separation allowing them to “roll up their sleeves” right from the onset of the matter. The parties control the process which leads to more focussed and cost-effective results.

Courtroom

We strive to resolve your family law matter outside of the Courtroom. However, in certain circumstances, litigation is required. The necessity of litigation may be apparent at the onset of your matter or will be recommended at a later stage. A strategic analysis is undertaken before each step in the process to ensure we achieve the best result for you. Our lawyers are skilled advocates in the Courtroom, experienced in all aspects of litigation, including trial advocacy.

Boardroom

Settlement discussions and negotiations are the first steps taken in family law disputes once the parties have exchanged disclosure. Our lawyers achieve optimal results through careful and strategic preparation, founded on years of experience in the Courtroom and a deep knowledge of family law. We will use our experience to formulate a settlement aligned with your goals, in a cost-efficient manner.

Alternative Dispute Resolution

When settlement discussions break down, we will review with you the advisability of moving your matter into Mediation. At times, Mediation may be helpful in resolving a dispute already in the Court system. Our lawyers regularly attend Mediation and are skilled in advocating your interests in a settlement-focused environment. Where appropriate, we will consider with you the process of Arbitration. In Arbitration, the parties opt out of the Court system and litigate their matter privately in a process akin to a trial in the public Court system. The parties select their arbitrator or private judge and can agree to tailor a more efficient process.

Our Team

Janet Miliaris, Counsel

Janet is a graduate of the Faculty of Law at the University of Windsor. She was called to the Ontario Bar in 1993.

Prior to attending Law School, Janet studied sciences and maths at the University of Toronto and holds a Bachelor of Science degree.

Since being called to the Ontario Bar in 1993, Janet has been entrusted to provide strategic and pragmatic guidance to her clients. Her passion for advocacy began as a first-year law student at the Crown Attorney’s in Toronto prosecuting non-criminal offences. Significant litigation and corporate law skills followed as a summer student and articling student with an international Bay Street law firm located in downtown Toronto.

Janet is committed to providing excellent personal service to her clients in a respectful manner. Having dedicated her practice to family law since 1996, she understands that family law clients are best served when they have a close working relationship with their counsel as they move through their separation: she answers her telephone when clients call.

In addition to guiding clients from separation to settlement, Janet has significant experience representing family law clients in contested Matrimonial and Estate proceedings in Courts throughout Ontario. She has developed a particular expertise negotiating marriage contracts and cohabitation agreements and is often referred clients from corporate counsel to prepare marriage contracts for their clients.

Janet is trained in the practice of Collaborative Family Law. The Collaborative Family Law practice allows divorcing and separating couples to put family first and reach creative resolutions without stepping foot in a courtroom. This alternative dispute resolution process allows parties to work together in order to resolve their legal issues amicably while maintaining a mutual respect for the family unit.

Janet has lectured on family law topics throughout her career and has been a guest lecturer at the Schulich School of Business in the MBA program. Her commitment to family law issues extends to volunteer work as Janet is a past Director and the past President of the Board of Directors of The Etobicoke Children’s Centre, a mental health centre providing mental health and autism services to children and their families.

Janet is a trained mediator and is a member of the Association of Family and Conciliation Courts.

Janet is conversationally fluent in Greek.

Joanna Kucz, Counsel

Joanna is a graduate of Osgoode Hall Law School. She was called to the Ontario Bar in 2004.

Joanna received an Honours Bachelor of Science degree from the University of Toronto where she specialized in Psychology and majored in Crime and Deviance. As she excelled in her studies, Joanna received recognition for her outstanding academic performance – she was on the Dean’s Honour List and invited to become a member of the Golden Key International Honour Society.

Joanna has dedicated her professional career to family law and has practised exclusively in this area since her call to the Ontario Bar in 2004. Joanna’s interest in family law was cultivated through law school, founded on a desire to help her clients and their families through difficult times. While still in law school, Joanna sought all opportunities to build courtroom skills and argued appeals and appeared before various tribunals through the Community Legal Aid Clinic. Joanna taught a college-level business law course, and thereafter articled at a boutique family law firm in Ottawa.

She has extensive experience in all areas of family law, including custody and access, child support, spousal support and complex property and financial issues. Joanna has particular expertise in drafting domestic contracts and complex court documents.

Joanna is also trained to resolve disputes through the collaborative process.

Joanna has appeared at various levels of Court throughout Ontario, including the Ontario Court of Justice and the Superior Court of Justice, and has represented clients at various stages in the Court litigation process. In addition to litigation, Joanna has also represented clients in family law mediation and arbitration proceedings.

Joanna’s clients benefit from her pragmatic, levelheaded approach. She is a strong advocate for her clients and strives to find the best solution in the most cost-effective manner. Although each case is different, Joanna considers litigation to be an option of last resort if there are less costly alternatives to resolving a dispute. Joanna has successfully negotiated many settlements for her clients outside of Court. However, sometimes litigation simply cannot be avoided and when needed Joanna is not afraid to fight it out in Court and will strongly advocate for and on behalf of her clients.
